REGULATIONS FOR THE ORGANIZATION AND OPERATION OF THE PAID PARKING SYSTEM FOR SHORT "PARKING REGULATIONS"
MULTI-FUNCTIONAL SHOPPING COMPLEX WITH UNDERGROUND PARKING, Sofia, p.k. 1407, Triaditsa district, 100 Cherni Vrah Blvd., property of Bulfeld EOOD ("Owner of Paradise Center"), "Hi-Tech Security" EOOD ("Company managing the Parking lot")
PREAMBLE
These Parking Regulations establish the general rules that must be observed by all visitors to Paradise Center and, in particular, by Users using the Parking Lot, in order to efficiently use the existing parking spaces and free movement.
The provisions of this Regulation are supplemented by applicable laws, including:
- Road Law
- Road traffic law
- ORDER No. 18 of 23.07.2001 on road signaling with road signs
The parking lot is private property, and the Users' access to it is possible only if they are in accordance with the present Parking Regulations and the applicable legislation. The car park is categorized and classified as a private road open to public traffic during the entire period that Paradise Center is open to the public.
When requesting the issuance of a ticket for access to the Parking, the person wishing to park (User) accepts and undertakes to comply with the conditions of these Parking Regulations and road signs.
CHAPTER 1 - GENERAL PROVISIONS
Art. 1. For the purposes of this Parking Regulation, parking spaces are designated spaces located on levels -2, -3 in Paradise Center, limited by lines perpendicular to the paths of car traffic, marked on the road surface with white paint.
Art. 2. Every driver is obliged to park his vehicle correctly so that it occupies one parking space and does not hinder/prevent the occupation of parking spaces in the immediate vicinity.
Art. 3. The company managing the Parking reserves the right to designate certain areas in the Parking, where specific rules will apply, according to the decision of the owner of Paradise Center.
Art. 4. Access to Parkinga is by requesting and receiving an access ticket from the special barriers placed at each entry point. Leaving the Parking is possible only after returning a valid parking ticket to the machines at the barriers and paying the parking fee.
CHAPTER 2 – PARKING SCHEDULE OF OPERATIONS
Art. 5. The operating schedule of the Parking lot is as follows:
Monday - Sunday, between 07:00 and 22:00
Parking in the Parking lot is permitted only within the working hours of the Parking lot;
CHAPTER 3 - PAYMENT SYSTEM - FEES AND RULES
Art. 6 The price of use for each occupied parking space in the Parking lot is determined according to the tariff specified below:
Art. 7 The applicable parking rate includes VAT and is as follows:
Stay up to 2 hours - free parking
Stay from 3 hours to 5 hours — BGN 2/hour including VAT
For every hour after the 5th — BGN 4/hour including VAT
After the tenth hour - BGN 6/hour including VAT
The user has the right to stay for 2 hours without paying a fee for one calendar day. These hours will be counted regardless of the number of times the User's vehicle enters the Parking Lot. After the initial 2-hour stay, the price for using a parking space is determined according to the length of stay and the rate above. The prices shown are for a full hour and are not divisible.
Any split of the time slot will be billed considering the full hour rate.
After paying the fee, the right to park is cancelled. Exit from the Parking lot will be carried out within 15 (fifteen) minutes after payment of the fee. Otherwise, an additional parking hour fee will be charged.
Art. 8 The parking fee is paid as follows:
a) through the payment machines located at the entrance / exits of parking levels /-2 and -3/, using coins or banknotes, as follows:
coins or bills are inserted directly into the machine. Banknotes with a nominal value of over BGN 50 (fifty) are not accepted. Only coins of 0.10, 0.20, 0.50, 1 BGN and 2 BGN can be used.
b) Manually in the Parking Office at parking level -3
Art. 9 In case of loss, destruction or deterioration of the ticket for access to the parking lot, a duplicate can be requested at the aforementioned payment points, against payment of 25 (twenty-five) BGN (including VAT) per day between 07:00-22:00 .
Art. 10 References relating to subscribers of the Paradise Center Parking:
• Loss or destruction of the card by the Subscriber will be charged BGN 25;
• In case of loss of the card, the Subscriber will notify the Parking Office to block the card.
Art. 11 Vehicles can park only within the marked parking spaces. It is forbidden to stay or park in places that are reserved by means of signs, signs for permanent use, in places for parking vehicles serving people with disabilities or in front of emergency exits, storage rooms, technical service rooms.
It is prohibited to enter, park and stay vehicles equipped with automotive gas systems (AGU) on the underground parking level. In the event of damages caused to the owner of the Shopping Center, the Company managing the Parking, and/or a third party and/or in the event of sanctions imposed by control authorities, as a result of non-compliance with this prohibition, the User of the Motor Vehicle bears full responsibility .
The user must comply with road signs and other rules for using the Parking Lot, as well as the instructions of the employees of the company managing the Parking Lot. In other cases, the provisions of the Road Traffic Act apply.
For the first violation of the present parking rules, the Company managing the Parking shall impose a fine of BGN 25 (twenty-five), including VAT. In the event that the User leaves the Parking lot with the vehicle without returning a valid ticket, even when this is a first violation, the Vehicle will not be allowed to enter the Parking lot for a period of up to 1 (one) year.
For each subsequent violation, the Company managing the Parking will not allow vehicles to the Parking for a period of up to 1 (one) year.
CHAPTER 4 – TRAFFIC AND PARKING RULES
Art. 12 The company managing the Parking reserves the right to prohibit the access of certain vehicles to the Parking at its discretion, such as, but not limited to, trucks with functionality unsuitable for using the Parking.
Art. 13 The maximum speed in the car park is 10 km/h, and Users must strictly follow road markings and signs. Access by animal-drawn vehicles or trailers with 4 or more axles is prohibited.
Art. 14 Parking of vehicles is allowed only in the specially marked places.
Art. 15 The access of delivery vehicles on a route other than that determined by the Company managing the Parking is prohibited.
Art. 16 Parking spaces reserved for people with disabilities may only be used by vehicles displaying the card issued by the competent authorities containing the international symbol. Disabled persons who hold the card have the right to park in the designated parking spaces. In this regard, disabled persons present the card to the Paradise Center representative to cancel the access ticket and of course the parking fee. The use of false cards to obtain these benefits will be reported to the police and the User will be liable to pay the full parking fee.
Art. 17 Entering the Parking lot constitutes the driver's tacit consent to the application of the provisions of these Parking Regulations.
Art. 18 The Parking Management Company will implement these Parking Regulations and will apply the relevant tariffs provided for therein.
Art. 19 Any noisy activities in the Parking lot are prohibited, unless there is prior written approval from the Company managing the Parking lot.
Art. 20 Users, customers and visitors undertake and accept the following:
A) Not to use the Parking for dangerous, illegal, unethical activities or for begging;
B) Not to use the Parking for the purpose of repairing motor vehicles, car maintenance activities, or other similar activities;
C) Not to organize any political or public meetings, strikes, performances, or commercial activities in the Parking lot;
D) Not to organize camping or picnics in the Parking lot, sports or other activities in the area;
E) Not to distribute advertising or other materials without the written permission of the Company managing the Parking;
F) Not to do anything that may violate public order, cause damage or inconvenience, both to the Parking lot and to its users;
G) Do not leave unattended animals or dangerous substances in vehicles;
H) And) Not to leave minors unattended in the Parking lot or in the parked vehicles;
I) Not to conduct professional photo sessions without the written consent of the Company managing the Parking;
J) Not to use horns;
K) Do not voluntarily park the vehicle with the engine running;
L) Not pollute with flammable, hazardous or organic substances;
M) Not to initiate or participate in competitions in the Parking Lot, without the consent of the Company managing the Parking Lot;
N) Not to leave their personal belongings unattended; Company managing the Parking and the Owner of Paradise Center do not accept responsibility for their disappearance;
O) Maintain the cleanliness of the Parking lot and dispose of garbage in the designated places;
P) Not to perform maneuvers that may be dangerous for other participants;
Q) Not to test/test their cars in the Parking lot;
R) Do not damage the Parking or its elements;
S) To park in the designated places without affecting the right of other users to park;
T) Not to park vehicles for more than 24 consecutive hours.
It is prohibited to enter, park and stay vehicles equipped with automotive gas systems (AGU) on the underground parking level. Art. 21 Company managing the Parking will provide visitors with civilized parking conditions, i.e. cleaning and proper lighting. The video cameras installed in the Parking lot are intended exclusively for monitoring traffic flows; the videos will not be available to the public, but will be made available to authorities upon request.
Art. 22 Parking outside working hours or for a period of more than 24 consecutive hours in the Parking lot is prohibited. In the event that the User continues to use the parking space after the expiry of the maximum time for the vehicle to stay in the Parking, he owes the payment of compensation for the use of the parking space to the Company managing the Parking, in the amount of BGN 500 (five hundred), incl. VAT.
CHAPTER 5 - OBLIGATIONS OF USERS
Art. 23 Users must fully comply with the rules for the operation of the Parking Lot, and if they violate any of the provisions of these rules, the User must pay the imposed penalty.
Art. 24 Users may not enter the parking lot without the ticket issued when the access barrier is opened, bearing in mind that exit is permitted only after payment and validation of the parking ticket.
Art. 25 All damages caused both to own vehicles and to other vehicles or facilities by the Users while driving or parking in the Parking lot will be covered by the guilty parties, excluding the Company managing the Parking lot and the Owner from liability.
Art. 26 When parking, the User is responsible for the items left in the vehicle by closing the doors, the engine cover and the trunk, the windows, the hatch, the tank cap, etc., as the Parking Management Company and the Owner are not responsible for their security any way.
Art. 27 Users are advised not to leave valuables in the vehicles, as the Parking Management Company and the Owner are not responsible for their disappearance.
Art. 28 Users must comply with the rules for fire safety as well as the instructions of the Company managing the Parking, the security company or the firemen, and the Users are directly responsible for the damage caused by them in case of non-compliance with the above-mentioned rules.
Art. 29 The driver and other passengers will keep the parking area clean and will not store any materials in the Parking lot; waste should be disposed of in dustbins.
CHAPTER 6 - SANCTIONS
Art. 30 The following constitutes a deviation from the current Parking Rules and is punishable by a fine of 25 (twenty-five) BGN, including VAT, and non-admission to the Parking Lot for a period of up to 1 (one) year. :
a. stopping or parking the vehicle in places other than those designated and marked, or occupying more parking spaces, parking in front of escape routes, or improperly parking in places designated for disabled people;
b. exhibiting the car for sale in the Parking lot, without prior approval from the Company managing the Parking lot.
Art. 31 Repeated speeding in the Parking lot will be punished by restricting the access of the corresponding vehicle to the Parking lot for a period of up to 1 (one) year
Art. 32 Violations are established on the basis of these Parking Regulations and with due observance of the current legislation regarding traffic on public roads, by the security officers or other employees of Paradise Center regarding compliance with the provisions of these Parking Regulations, and by the competent state authorities regarding compliance with the provisions of applicable legislation.
CHAPTER 7 - LOCKING AND/OR DETENTION OF THE VEHICLE
Art. 33 At the discretion of the Parking Management Company, vehicles blocking or impeding traffic, parked in other parking spaces, other than those designated, marked with a green light, parked for a longer period than specified in Art. 22, as well as those who occupy parking spaces for disabled persons without having the card under Art. 16, will be locked and/or detained, transported and stored, as well as those who occupy the parking spaces for disabled people without possessing the card specified in Art. 16.
User of the vehicle expressly accepts the blocking of wheels/windshield and the detention, transportation and storage of the vehicle at specified locations by an economic operator authorized to provide such services through a contract concluded by the manager of Paradise Center in all cases specified herein Art. 33; the owner/driver User of the vehicle will fully pay all costs of detention, transport and storage in accordance with Art. 64, para. 2 of PNS 195/2002, charged by the external service provider, as well as the additional parking fee provided for in Art. 5, the unlocking fee referred to in Art. 14 above. Company managing the Parking and/or the Owner of Paradise Center are not responsible for damages that may occur as a result of locking and/or impoundment, transportation and/or storage of the vehicle.
Art. 34 One of the front wheels of the car or the windshield will be blocked with special devices. The locking device will be yellow and impossible to remove; changing the locked wheel will also be impossible. Impounded vehicles will be placed in designated areas with their front wheel locked. After the impoundment, it will be announced through the Paradise Center communication system, indicating the registration number of the vehicle.
Art. 35 Before locking the wheels or impounding the vehicles, they will be photographed to prove the violation of this Regulation by the driver. Also, pictures will be taken after locking - with the wheel or windshield locked. A notice will be posted on the windshield of locked vehicles containing information about the violation under this Regulation and the steps the User must follow to unlock the vehicle, i.e. fill out a form at the Paradise Center Information Desk, pay the release fee and sign the unlocking protocol.
Art. 36 The wheels will be unlocked after reminding the driver of the provisions of the Regulation.
CHAPTER 8 - VEHICLE DAMAGES
Art. 37 Paradise Center security officers have no obligation to guard the cars parked in the Parking Lot.
Art. 38 The owner of Paradise Center does not assume any civil or criminal liability for any damage, theft, fire and any damage caused by third parties to the vehicles in the Parking and/or items left in them.
In connection with the above, the Company managing the Parking and the Owner are not responsible to the User even after the car leaves the Parking.
Personal data
""Hi-Tech Security" EOOD holding License for private security activity No.: 3072/ 13.12.2016, issued by the Main Directorate "National Police", implements a security regime with physical forces and technical means on the Parking lot at the "Paradise" Shopping Center on the basis of the contract for security services for the "Paradise" shopping center dated 30.01.2018. When carrying out its activities, on the basis of art. 11 para. 2 of the Law on private security activities, the company carries out video surveillance in compliance with the Law on the Protection of Personal Data .
The company managing the Parking lot processes the registration numbers of motor vehicles in order to comply with the rules for using the Parking lot.
By picking up a parking ticket or entering the Parking lot, the User gives his express consent to "Hi-Tech Security" EOOD to process the registration number of the motor vehicle he drives. Pursuant to Art. 56 para. 3 of the Law on Private Security Activities "Hi-Tech Security" EOOD, by means of information boards, informs all visitors and users of the Parking lot about the use of technical means for video surveillance.
The personal data collected through the means of video surveillance will be stored by "Hi-Tech Security" EOOD on the basis of Art. 56 para. 4 of the Law on Private Security Activities - for a period of up to two months and depending on the technological capabilities of the Video Surveillance system.
Every natural person has the right of access to the personal data concerning him, as well as the right to request that the same be deleted, corrected or blocked, when their processing does not meet the requirements of the Personal Data Protection Act.
CHAPTER 9 - FINAL PROVISIONS
Art. 39 The Owner reserves the right to change these Parking Regulations at any time and without notice.
Art. 40 Any vehicle parked for more than 2 consecutive calendar days will be considered abandoned.
Art. 41 The provisions of this Parking Regulation also apply to supply or delivery vehicles, as well as to taxis.
Art. 42 These Parking Regulations and samples thereof will be placed in visible places provided for this purpose, on the territory of the Parking Lot.
